Superfit Contest rules and Regulations
RULES AND REGULATIONS - Contest This Pair of Shoes could be Free -
1. NO PURCHASE IS NECESSARY TO ENTER THIS CONTEST (the "Contest").
2. All monetary amounts herein are calculated in Canadian dollars.
3. The Contest is open to all residents of Canada who have reached the age of majority in the province in which they reside, except the directors, officers, agents and employees of Goedike Canada Inc. and all of its affliated and their advertising and promotional agencies and members of their respective immediate families living in the same household.
4. By entering the Contest, each entrant accepts the terms and conditions of these contest rules and regulations (the "Rules") and agrees to be bound by them. The Contest is subject to all applicable federal, provincial and local laws and regulations. The Contest is void where prohibited by law.
5. To enter for a chance to win a Prize (described below), simply go online at www.superfitshoes.com (the "Website") and follow the instructions to fill out an on-line ballot or make your way to the - Superfit Shoes Page on Facebook http://www.facebook.com/SuperfitShoes and follow the instructions to fill out an on-line ballot.
5.1 One (1) entry per person will be accepted throughout the entire contest period;
5.2 One (1) e-mail address per person;
5.3 one (1) entry will make you eligible for every monthly prize.
6. Two (2) pairs of Superfit Shoes (March Prizes) individually draw in the month of March, will be awarded consisting of: two (2) individual draws of one (1) pair of Superfit shoes (approximate retail value $70)
Two (2) pairs of Superfit Shoes (April Prizes) individually draw in the month of April, will be awarded consisting of: two (2) individual draws of one (1) pair of Superfit shoes (approximate retail value $70)
Two (2) pairs of Superfit Shoes (May Prizes) individually draw in the month of May, will be awarded consisting of: two (2) individual draws of one (1) pair of Superfit shoes (approximate retail value $70)
One (1) Grand Prize (the "Grand Prize") will be awarded consisting of one (1) $200 gift cards of Superfit products for one year (retail value $200), draw in the month of June 2012
7. Prizes must be claimed within two (2) weeks of its award. No cash, product substitution or prize equivalent shall be permitted. Prizes cannot be combined or used in conjunction with any other contest or offer. Prizes must be accepted as is, and cannot be redeemed for cash. No component of the Prizes may be returned after pick-up. No rain checks shall be provided.
8. The Contest offer shall be valid between February 27th 2012 at 0h00 min 1sec. Eastern Time and June 20th, 2012 at 23h 59 min 59 sec. Eastern time (the "Entry Deadline"). All entries for the Contest must be received by Goedike Canada Inc. prior to the Entry Deadline. Entries generated by a script, macro or other automated means are void. Entries that contain typographical errors, are altered, tampered with, incomplete, inaccurate, irregular in any way, or otherwise not in compliance with the Rules, shall also be disqualified. Odds of winning the Prizes will vary depending on the number of eligible Contest entries received. All entries become the property of Goedike Canada Inc.
9. Two (2) random draws will be held at the head offices of Goedike Canada Inc. in Laval, Quebec on March 23th, 2012 at approximately 12h00 Eastern time (the "March Draw Date"), in order to select the March Prizes winners among all of the eligible entries received by March21th at 23h 59 min 59 sec. Eastern time.
Two (2) random draws will be held at the head offices of Goedike Canada Inc. in Laval, Quebec on April 20th, 2012 at approximately 12h00 Eastern time (the "April Draw Date"), in order to select the April Prizes winners among all of the eligible entries received by April 18th at 23h 59 min 59 sec. Eastern time.
Two (2) random draws will be held at the head offices of Goedike Canada Inc. in Laval, Quebec on May 18th, 2012 at approximately 12h00 Eastern time (the "May Draw Date"), in order to select the May Prizes winners among all of the eligible entries received by May 16th at 23h 59 min 59 sec. Eastern time.
A random draw will be held at the head offices of Goedike Canada Inc. in Laval, Quebec on June 22th, 2012 at approximately 12h00 Eastern time (the "Grand Draw Date"), in order to select the Grand Prize winner among all of the eligible entries received by the Entry Deadline.
10. Only the selected winners will be contacted by email, mail, Facebook Mail or telephone within ten (10) business days of the Draw Date. If the selected winner cannot be reached within ten (10) business days of the Draw Date, the selected winner will be disqualified and another winner will be selected by a random drawing conducted by Goedike Canada Inc. until such time as contact is made by email, mail, Facebook Mail or telephone with a selected winner. Goedike Canada Inc. will not be responsible for failed attempts to contact a selected winner. If a Prizes cannot be awarded due to actions or circumstances beyond the control of Goedike Canada Inc., a substitute prize of equal or greater retail value may be awarded. The name of the Prizes winners shall appear on the Website or / and Superfit Shoes Page on Facebook for no less than thirty (30) days following selection and confirmation of said winners.
11. Goedike Canada Inc. reserves the right to verify eligibility qualifications of the Prizes winners. The Prizes winners must comply with these Rules and correctly answer a time-limited, mathematical skill-testing question (without the assistance of another person or mechanical device) to be administered by a representative of Goedike Canada Inc. during a pre-arranged, mutually convenient telephone call. The Prizes winners upon request may have to produce valid documents essential to participate. In addition to the foregoing and in order to be eligible to receive the Prizes awarded hereunder, the Prizes winners must execute a full release and affidavit of eligibility in a form to be provided by Goedike Canada Inc. which relieves Goedike Canada Inc. from any and all liability for injury associated with any prize awarded to him/her, as well as satisfy any and all laws and regulations and other criteria required by the Prize winner's province of residence. Once the Prize winners has satisfied these requirements, he/she will be entitled to claim the Prize. Should the Prize winners not claim his/her Prize within the specified time, not comply with the Rules or incorrectly answer the time-limited mathematical skill-testing question, an alternate Prize winner (or winners) will be selected, by random drawing, conducted by Goedike Canada Inc.
12. By entering the Contest, all entrants irrevocably grant to Goedike Canada Inc. the right to include their name and information (including e-mail address) on any of Goedike Canada Inc. mailing/e-mail lists for promotional purposes relating to Goedike Canada Inc. and to use their name in any publicity carried out by Goedike Canada Inc., and agree to grant to Goedike Canada Inc. a non-exclusive irrevocable license and right to incorporate, use and reproduce their photograph, voice, name, likeness and city and province of residence in whole or in part in and in connection with the advertising, exhibiting, marketing, promotion and exploitation of its business in any manner, in all media throughout the world. Those individuals who do not wish that their personal information be used for such purposes are required to so indicate in writing to Goedike Canada Inc. at the following address: 3460 Boul. 13. All expenses related or incidental to the receipt and use of a Prize, including all surcharges, taxes (federal, provincial and local), and travel costs between the Prize winner's residence and the prize location, shall be the sole responsibility of the Prize winner. Without limiting the generality of the foregoing, all expenses not specifically stated herein to be the responsibility of Goedike Canada Inc., shall be the sole responsibility of the Prize winner. No refund or compensation of any costs or expenses incurred by the Prize winner shall be made. Prizes are non-refundable, non-transferable and may not be reissued or revalidated.
14. Goedike Canada Inc. shall not be responsible for lost, stolen, mutilated, late, misdirected or ineligible entry forms or for any computer, online, human or technical malfunctions that may occur in the administration of the Contest. Subject to a contrary ruling by the Régie (as defined below), if for any reason the Contest is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other cause beyond the control of Goedike Canada Inc. or any act corrupts or affects the administration, security, fairness, integrity or proper conduct of the Contest, Goedike Canada Inc. reserves the right, in its absolute and sole discretion, to disqualify an individual and/or cancel, terminate, modify or suspend the Contest. Goedike Canada Inc. shall not be responsible under any conditions whatsoever for any problems or technical malfunctions relating to the Contest or for any printing or typographical errors or problems in connection with any Contest-related materials. Any attempt by anyone to damage or disrupt the Contest shall be considered a violation under criminal and civil law. Goedike Canada Inc. reserves the right to seek damages or other remedies against such person to the fullest extent permitted by law, including criminal prosecution.
15. All entrants assume all liability for injuries caused or claimed to be caused by participation in the Contest, or the use or misuse of any prizes granted herein, including any and all losses, damages, claims, costs, actions and causes of action with respect to the Prizes (including without limitation, in connection with travel, if applicable). Without limiting the generality of the foregoing, by entering the Contest, entrants release and forever discharge Goedike Canada Inc.and its parent companies, affiliates, subsidiaries, agents, and advisors and the employees, officers, directors, shareholders, agents, and representatives of Goedike Canada Inc., from any and all damages, rights, claims and actions of any kind whatsoever arising in connection with the Contest or resulting from acceptance, possession, or use or misuse of any prize awarded in connection with the Contest, including without limitation personal injury, death, and/or property damage as well as claims based on publicity rights, defamation, or invasion of privacy.
16. For on-line entries, in the event of any dispute regarding entries received from multiple users having the same e-mail account, entries will be deemed to be made by the authorized account holder of the e-mail address submitted during entry. The "authorized account holder" is the natural person who is assigned to the e-mail address by an internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. Winning entries may be required to provide Goedike Canada Inc. with proof that the claimed winner is the authorized account holder of the email address associated with the winning entry, or forfeit the Prize.
17. It is the entrant's sole responsibility to notify Goedike Canada Inc. in writing at the address indicated above if he/she changes his/her address or other contact information. All corrections must be received prior to the Entry Deadline.
18. If any terms of the Rules are or become invalid, are ruled illegal by the Régie (as defined below) or any court of competent jurisdiction, or are deemed unenforceable under then current applicable law, it is the intention of the parties hereto that the remainder of the Rules shall not be affected thereby and shall remain in full force and effect.
19. For Quebec entrants, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux (the "Régie") for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
